   Your entire value proposition is that a pair sold on your platform is real. Hire or train authenticators, document a written inspection process, and keep records on every item. State plainly to yourself and your users that no process is perfect, which is exactly why a stated authenticity guarantee is a legal liability: Nike's 2022 lawsuit against StockX documented a counterfeit failure rate above 50 percent on a sample purchase, a direct attack on a marketplace's core promise. Decide early whether you promise a guarantee or a rigorous best-effort verification, and word it with counsel.

   Write the consignment and authenticity terms with a lawyer

   You are holding other people's goods and money and making authenticity claims, so the paperwork is the business. Cover your commission and fee schedule, who bears loss for damage or a missed fake, payout timing, return and dispute handling, and your liability limits on authentication.    Handle payments, sales tax, and seller reporting correctly

   As a marketplace facilitator you are generally responsible for collecting and remitting sales tax on transactions, and you must issue the tax forms sellers receive over reporting thresholds. Integrate a payments and payout system that handles escrow-style holds until authentication clears. Getting tax and payments compliant is not glamorous, but it is what lets you operate legally across states and keep sellers and regulators trusting you.

   Grow both sides of the market at once

   A marketplace dies if either sellers or buyers are missing. Recruit sellers with fair tiered commissions and fast, reliable payouts, and pull buyers with authenticated selection, honest condition grading, and trust signals. Track liquidity (how fast a listed pair actually sells) as your core health metric, because thin liquidity, not lack of features, is what kills sneaker marketplaces.

   Scale the operation only as unit economics prove out

   Add authentication capacity, categories, and regions only when your take rate genuinely covers the cost of verifying and moving each pair. The incumbents reached profitability by pushing enormous volume through owned infrastructure at a disciplined take rate, and that is context, not a promise. Grow when each new pair pays for its own authentication and handling, not before.
